A man accused of assault in the first degree, two counts of assault in the second degree and related weapons charges, was cleared by an Orange County Court jury.
The charges stemmed from a fight outside of a popular Newburgh night spot "90 Broadway" on January 15, 2000. It was alleged that James Root sustained injuries resulting in the loss of his right eye. The jury of seven women and five men deliberated four hours before reaching a verdict finding Stanley Shields, 23, of Carmel, not guilty on all counts. Shields was represented by Benjamin Ostrer. Assistant District Attorney Michael Milza prosecuted the case on behalf of the Orange County District Attorney's Office.
Shields had previously entered a plea of guilty to the charge of attempted assault in the first degree. That plea was later vacated by Judge Stewart Rosenwasser.
