As one of the Hudson Valley’s most respected and diverse personal injury law firms, we are proud of our reputation as lawyers dedicated to fighting for the injured throughout the Ulster, Dutchess, Sullivan, Rockland and Orange County NY area.
Accidents and injuries that occur in the workplace may involve gross negligence on the part of employers or third parties. While workers’ compensation benefits may provide for initial medical costs and lost wages, serious injuries that result in long-term disability may include financial costs and pain and suffering not covered. At the law office of Ostrer & Associates, our lawyers work with accident investigators, medical experts and medical economists to determine the scope and nature of a construction or workplace accident. We expose OSHA violations, unsafe conditions, poor training and general negligence that lead to serious injuries for our clients.

Recovering Damages Under Section 240 of the New York State Labor Law
New York State law provides special protection for workers who are injured in falls from heights caused by the failure of safety equipment, regardless of whether a ladder, scaffold, or harness was involved. In a qualifying case under Section 240 of the New York State Labor Law, a worker injured in a fall or by a falling object has the right to recover his or her full damages from the property owner or contractor. These damages can include not only lost wages and medical care, but also compensation for pain and suffering, future medical care and physical therapy, and training for a new occupation.
Our lawyers evaluate your situation and advise you whether you have the right to sue a building site owner or contractor if you have been injured in a fall from a ladder or a scaffold, or if you suffered a closed head injury or brain trauma caused by a falling object at work.
